Maria Perez, claimant in this workers compensation cause, appeals an order of the judge of compensation claims (JCC) dismissing her claim for attendant care benefits with prejudice. The issues for our review are (1) whether the JCC erred in failing to accept claimants voluntary dismissal of her claim at the commencement of the hearing, and (2) whether the JCC erred in denying and dismissing the claim with prejudice. We quash the order.
